Privacy Policy

If you are our customer, newsletter subscriber or website visitor, you entrust us with your personal data. We are responsible for their protection and security. Please familiarise yourself with our personal data protection policy, principles and the rights you have in connection with GDPR (General Data Protection Regulation).

1. WHO IS THE CONTROLLER

I am Martha Gadula Papafoti, Legerova 8, 715 00 Ostrava, ID No.: 65866738, and I operate the website marthadance.cz. We process your personal data as a controller, i.e., we determine how the personal data will be processed and for what purpose, for how long, and we select any other processors who will assist us with the processing.

3. WE DECLARE

We declare that as the controller of your personal data we comply with all legal obligations required by applicable legislation, in particular the Data Protection Act and GDPR, and thus that:

  • we will process your personal data only on the basis of a valid legal reason, in particular legitimate interest, performance of a contract, legal obligation or granted consent,
  • we fulfil the information obligation under Article 13 of the GDPR even before we start processing personal data,
  • we will enable you and support you in exercising and fulfilling your rights under the Data Protection Act and GDPR

4. SCOPE OF PERSONAL DATA AND PURPOSES OF PROCESSING

We process personal data you provide yourself for the following reasons (to fulfil these purposes):

  • Provision of services, performance of a contract
    we need your personal data to the extent: e-mail, address, etc. to fulfil the contract (e.g., sending access to the application, sending an online course, delivering goods).
  • Bookkeeping
    If you are a customer, we necessarily need your personal data (billing details) to comply with the legal obligation to issue and record tax documents.
  • Marketing - sending newsletters
    We use your personal data (e-mail and name), gender, what you click on in the e-mail and when you most often open it for direct marketing purposes - sending commercial communications. If you are our customer, we do so on the basis of legitimate interest, as we reasonably assume you are interested in our news, for 5 years from your last order.

If you are not our customer, we send you newsletters only on the basis of your consent, for 5 years from the granting of such consent. In both cases you can revoke this consent using the unsubscribe link in each email sent.

We retain your personal data for the duration of the limitation periods unless the law provides for a longer period of retention or unless we state otherwise in specific cases.

6. SECURITY AND PROTECTION OF PERSONAL DATA

We protect personal data to the maximum possible extent using modern technologies corresponding to the level of technical development. We protect it as if it were our own. We have adopted and maintain all possible (currently known) technical and organisational measures to prevent misuse, damage or destruction of your personal data.

7. DISCLOSURE OF PERSONAL DATA TO THIRD PARTIES

Our employees and associates have access to your personal data.

To ensure specific processing operations that we cannot provide ourselves, we use the services and applications of processors who can protect data even better than we can and who specialise in such processing.

These are providers of the following platforms:

  • Shoptet a.s.
  • SmartSelling a.s. (SmartEmailing)
  • Facebook
  • Google
  • accounting firm

It is possible that in the future we may decide to use additional applications or processors to facilitate and improve processing. However, we promise you that in such a case we will place at least the same demands on the security and quality of processing as we do on ourselves.

8. TRANSFER OF DATA OUTSIDE THE EUROPEAN UNION

All personal data processing will take place within the EU.

9. YOUR RIGHTS IN RELATION TO THE PROTECTION OF PERSONAL DATA

In relation to the protection of personal data you have a number of rights. If you wish to exercise any of these rights, please contact us by email: martha@marthadance.cz.

You have the right to information, which is fulfilled by this information page with the principles of personal data processing.

Thanks to the right of access, you can at any time ask us and we will provide you within 30 days with information on what personal data we process and why.

If anything changes for you or you find your personal data outdated or incomplete, you have the right to supplement and change your personal data.

You can exercise the right to restrict processing if you believe that we are processing your inaccurate data, believe that we are processing it unlawfully, but do not want all the data deleted, or if you have objected to the processing.

You can restrict the scope of personal data or the purposes of processing. (For example, by unsubscribing from a newsletter you restrict the purpose of processing for sending commercial communications.)

Right to data portability

If you wish to take your personal data and transfer it to someone else, we will proceed in the same way as when exercising the right of access - except that we will provide the information in a machine-readable form. Here we need at least 30 days.

Right to erasure (right to be forgotten)

Your next right is the right to erasure (to be forgotten). We do not want to forget you, but if you wish, you have the right to do so. In such a case, we will delete all your personal data from our system and from the systems of all sub-processors and backups. We need 30 days to ensure the right to erasure.

In some cases we are bound by a legal obligation, for example, we must keep issued tax documents for the period specified by law. In this case, we will delete all personal data that is not bound by another law. We will inform you by email of the completion of the deletion.

Complaint to the Office for Personal Data Protection

If you feel that we are not handling your data in accordance with the law, you have the right to contact the Office for Personal Data Protection at any time with your complaint. We would be very happy if you would inform us of this suspicion first so that we can address it and remedy any wrongdoing.

Unsubscribing from newsletters and commercial communications

We send emails with inspiration, articles or products and services to you if you are our customer on the basis of our legitimate interest.

If you are not yet a customer, we send them only with your consent. In both cases you can stop receiving our emails by clicking the unsubscribe link in each email sent.

10. CONFIDENTIALITY

We would like to assure you that our employees and associates who will process your personal data are obliged to maintain confidentiality about personal data and security measures, the disclosure of which would jeopardise the security of your personal data. This confidentiality continues even after the termination of contractual relationships with us. Without your consent, your personal data will not be disclosed to any other third party.
